General conditions of sale
Introduction
These General Conditions of Sale concern the purchase of products and services, carried out remotely via electronic network on the website http://store.edidomus.it and on all the websites connected to it (Quattroruote, Ruoteclassiche, Tuttotrasporti, Quattroruotine, Domus, Meridiani, Volare, Cucchiaio, Dueruote, TopGear, X Off Road), belonging to the "Ed Network" owned by Editoriale Domus S.p.A. with registered office in Rozzano (Milan) at via Gianni Mazzocchi 1/3.
Such purchases are open exclusively to direct user Clients, with the express exclusion of parties such as merchants, wholesalers, retailers, professionals, etc., intending to resell the products to third parties. All purchases shall be subject to the provisions of Legislative Decree no. 185 of 22 May 1999 and, as far as the protection of personal data is concerned, to the provisions of Legislative Decree no. 196 of 30 June 2003.
Acceptance of the General Conditions of Sale
The Customer, by the electronic transmission of the confirmation of his or her purchase order, accepts unconditionally and undertakes to comply in his or her relations with Editoriale Domus S.p.A., hereinafter ED Store, with these General Conditions of Sale and the methods of payment, and declares that he or she has examined and accepts all the instructions provided, pursuant to the above-mentioned laws, and in addition acknowledges that Editoriale Domus S.p.A. may not be bound by different conditions, if not previously agreed in writing.
Duties of the Client
These General Conditions of Sale must be examined on line by the Client visiting the ED Store website before confirming the purchase. Therefore, by forwarding the confirmation of the order, the Client acknowledges and accepts such conditions.
After the on line purchase procedure is completed, the Client undertakes to print out these General Conditions of Sale, already examined and accepted during the purchase procedure, in order to satisfy in full the provisions of articles 3 and 4 of the above-mentioned legislative Decree 185/99.
Methods of purchase of editorial products
Editorial products may be purchased through the ED Store website.
The purchase of such products, as displayed and described on line in the relative descriptive and technical pages, is made by the Client at the price indicated, to be confirmed when forwarding the order confirmation, plus P&P costs as specified upon purchase.
Before completing the purchase, the unit cost for each product chosen, the total cost in case of purchase of several products as well as the total P&P cost will be displayed for the Client.
To confirm the purchase, on completion of the transaction, the Client will receive a message via e-mail containing the Number, Date and total Amount of his/her order.
By simply clicking on the icon next to each product it is possible to add the product itself to the basket. It is also possible to remove products from the basket before the purchase, in case the Client makes a "click too many".
It will be possible to check the content of the basket at all times by clicking on "cart". From the basket page it will be possible to decide whether to continue shopping or to proceed to the check-out. In this case the system will require the details to carry out both the transaction and the delivery.

Methods of purchase of electronic products
Electronic products may be purchased through the Ed Store website.

Payment
Purchases made from Italy may be paid for as follows:
• By Credit card. ED Store is not responsible for any fraudulent or illicit use by third parties of credit card details disclosed in relation to payment for the products purchased. In fact, ED Store never becomes aware of the purchaser’s credit card number, which is processed using a protected connection to the company Setefi, part of the Banca Intesa Group, which manages the service.
• By credit transfer to postal current account no. 55953202 (for subscriptions) and no. 668202 (for other editorial products), under the name of Editoriale Domus S.p.A. via Gianni Mazzocchi 1/3, 20089 Rozzano (Mi).
• Cash on Delivery. The payment can only be made in cash (bank or cashier’s checks are not accepted) upon receipt of the goods.
• Non-transferable check made out to: Editoriale Domus S.p.A. via Gianni Mazzocchi 1/3, 20089 Rozzano (MI).
Purchases made from abroad may be paid for as follows:
• By Credit card. ED Store is not responsible for any fraudulent or illicit use by third parties of credit card details disclosed in relation to payment for the products purchased. In fact, ED Store never becomes aware of the purchaser’s credit card number, which is processed using a protected connection to the company Setefi, part of the Banca Intesa Group, which manages the service.
• By bank transfer (only valid for subscriptions). The reason for payment must include: the number and the date of the order and the name and surname of the person making the payment. Bank transfers shall be made out to: Editoriale Domus S.p.A. via Gianni Mazzocchi 1/3, 20089 Rozzano (Mi); Intesa Sanpaolo SpA, Via Caboto 41/43 - 20094 Corsico (MI), IBAN IT26I 03069 33034 100000002749, SWIFT BCITITMM.
• Non-transferable check made out to: Editoriale Domus S.p.A. via Gianni Mazzocchi 1/3, 20089 Rozzano (MI).
Security
The ED Store website is a service offered in collaboration with the company Setefi, part of the Banca Intesa Group. For this reason, addresses relating to setefi.it/monetaonline.it websites may be displayed during the transaction. All communications between your browser and the server are encrypted using the SSL (Secure Socket Layer) security protocol.
In this manner all your data, and more specifically the credit card number, are rendered unreadable during all of the phases of the purchase procedure, thus guaranteeing secure and private communication (you may verify in person if the method is secure by checking if the ‘locked padlock’ icon is displayed in the bottom left corner of the browser page).
Once the purchase is completed, you will receive a confirmation e-mail listing all the operations carried out in relation to the transaction. The credit card will be debited only after the delivery of the goods ordered.

Product delivery
The products purchased will be delivered by ED Store to the address specified by the Client.
Deliveries are made on working days. Said deliveries by ED Store may also be made at different times without any responsibility being incurred by ED Store.
For the delivery of its products, ED Store uses carefully selected, reliable firms.
The Client must check the products upon receipt and the consistency of the products delivered with the order made, and more specifically ensure that:
• the number of items indicated in the carrier letter corresponds to the number of items actually delivered;
• the parcel has not been tampered with, and is not damaged or wet.
The Client should sign the delivery note only after checking the above. If the delivery note has been signed, the Client will have no right to make any claims with regard to the exterior appearance of the items received. In case the products received are not consistent with the order made, the Client should not accept the goods and should make a claim directly to the carrier.
Cancellation and withdrawal rights
The Client has the right to cancel the order made within 24 hours (1 working day), by sending a written notice via email to ED Store. Should the Client fail to do so within this time limit and by using the method stated, the contract shall be deemed to be concluded. In case the amount due has already been debited to the Client, ED Store shall instruct the crediting of the sums paid on the same day.
According to and within the limits of the above-mentioned Legislative Decree no. 185/99, the Client has the right to withdrawal within 10 (ten) working days from the date the products ordered were received.
Said right applies to all the products contained in the ED Store website, with the explicit exclusion of electronic products, software products, audio-visual products or IT software delivered sealed and subsequently opened by the Client.
With regard to the previously mentioned Legislative Decree no. 185/99, it must be noted that the right of withdrawal is applicable exclusively to ‘consumer’ Clients, therefore only to natural persons who purchase the products for their own use and not for purposes relating to their professional activity, thereby excluding merchants, retailers, professionals, etc.
How to exercise the Right of Withdrawal
In order to exercise the right of withdrawal, the Client shall send, by the deadline set out in the previous article (Cancellation and Withdrawal Rights) of these General Conditions of Sale, a registered letter with notice of receipt, or a fax or telegram which must subsequently be confirmed by a registered letter with notice of receipt, within 48 hours (2 working days), to the following address:

ED Store will communicate to the Client, via email, the ‘Numero di Rientro’ (NAR – Number of shipment) for the product within one working day of the receipt so that it can be specified on the items to be returned to facilitate their delivery.
ED Store will then proceed to credit the costs of the goods delivered and of the initial P&P costs within 14 (fourteen) working days from the date when the goods were sent by the Client and, in any case, not before having received the products themselves. This transaction will be carried out through the banking institution that issued the Credit Card used or by crediting the bank current account specified by the Client.
The costs relating to the delivery of the products from the Client to the sender are charged to the Client. ED Store shall refuse to accept any products returned without proper packaging, and in any case sent using methods different from those specified above, or the products for which the shipment costs were not paid by the Client in full.
ED Store shall refuse to accept any products for which the shipment costs were not paid by the Client in full, or sent without complying with the methods and deadlines set out by Law (article 5 of Legislative Decree no. 185/99) with regard to communication relating to withdrawal rights, in case the product was returned without the original packaging, without all the accessories, instruction manuals and anything else included in the original delivery.
Protection of personal data
According to article 23 of Legislative Decree no. 196 of 30 June 2003, the Personal Data Protection Code, the Client expressly grants his/her permission to Editoriale Domus S.p.A. – with Registered Office in Rozzano (Milan) at Via Gianni Mazzocchi 1/3 – to collect, use and distribute his/her personal data provided when filling out the on line forms necessary to complete the purchase, in order to carry out all the operation strictly connected to and useful for the processing of the order and delivery procedures for the products purchased as well as for the purposes set out by Law.
Furthermore, the Client hereby acknowledges that he/she is aware that, in case he/she has granted his/her permission, his/her personal data shall be included in the "ED Store Clients Database" and may be used for promotional activities or to send promotional information regarding Editoriale Domus S.p.A.
The Data Subject may exercise the rights set out in article 7 of the above mentioned Legislative Decree 196/2003, and more specifically the right to request confirmation regarding the existence of his/her personal data at the premises of Editoriale Domus S.p.A., to know the source of the personal data, the logic applied to their processing, to obtain the updating, rectification and integration of the data, to request their cancellation, transformation in anonymous form or their blocking in case of unlawful use, to object to the processing of data on legitimate grounds or where it is used for the purpose of sending advertising material, commercial information, market research, direct selling and interactive commercial communications. The cancellation of the personal data of the Data Subject must be requested in writing with a letter sent to the registered office of the company.

Applicable Law and Place of Jurisdiction
These General Conditions of Sale are subject to the Italian Law. Any disputes arising with regard to the validity, interpretation or execution of this contract shall be governed by the local Courts of the place where the consumer is resident or domiciled, provided it is within the territory of the State.
Subscriptions
Time required to activate the subscription
Subscriptions requested on line are processed within 5 working days from when the order form was filled out and the details entered were confirmed by clicking on the appropriate field at the end of the purchase transaction.
The first magazine delivered generally corresponds to the first issue following the date the order was confirmed.
IMPORTANT NOTICE IN CASE OF RENEWAL OF SUBSCRIPTION
It is not possible to renew the subscription online. Please wait to receive the notice that will be sent to you before the subscription expires and follow the instructions contained in it.
Delivery methods
Italy
Subscription magazines are sent via ordinary post.
Other countries
According to the tariff selected, subscription magazines can be sent abroad either via ordinary post or express postal delivery service.

The subscription can be paid for using the following methods:

- pre-completed payment slip to be paid at the post office, which will be sent after the order has been processed

The subscription can be paid for using the following methods:

Change of address
If the subscriber changes his/her address, either temporarily or definitively, it will be necessary to communicate the new address at least four weeks in advance by calling the toll-free number 800.001199 (Italy only), or by sending a fax to the number +39 02 82 47 23 83, or by sending an email to the address uf.abbonamenti@edidomus.it. This service is free of charge.
Gifts
If the subscription includes a gift, this will be sent by ordinary post as soon as the payment is received. On average, this takes around 14 days from when the payment is processed.
The advantages of subscriptions
Frozen price
For the whole duration of the subscription, the price will remain the same also in case of increases in price for the single issues.
Home delivery
The magazine will be delivered to the address communicated by the Client with a P&P charge.
Guaranteed reimbursement
Should the Client decide to cancel the subscription for any reason, the amount corresponding to the issues not yet delivered will be reimbursed.
No issues will be missed
The subscriber will always be sure to receive all the issues. If for whatever reason any of the issues is lost, the subscriber can request a new delivery free of charge by calling the 800.001199 (Italy only), or by sending a fax to the number +39 02 82 47 23 83, or by sending an email to the address subscriptions@edidomus.it.
